Terms And Conditions

These Terms and Conditions (“Terms”) govern the use of this website and the freelance graphic design services provided by Case Designs (“we”, “us”, or “our”), operated by Emily Case.

By engaging our services or using this website, you agree to these Terms.

1. Services

We provide freelance graphic design services including (but not limited to) branding, logo design, digital design, and related creative services.

The specific scope, deliverables, timelines, and project requirements will be agreed in writing before work begins.

    2. Project Scope & Approvals

    All project details must be confirmed before work commences.

    Any work requested outside the agreed scope may incur additional fees, which will be approved by the client prior to completion.

     

    3. Pricing & Payment

    Project pricing will be outlined in a written quote, proposal, or invoice prior to commencement.

    Quoted prices are valid for 30 days unless otherwise stated.

    A deposit may be required before work begins. The remaining balance is due upon completion of the project or as otherwise agreed in writing.

    Invoices may be issued every 14 days for ongoing projects.

    Final files and deliverables will not be supplied until all outstanding invoices have been paid in full.

    Late payments may incur interest at a rate of 2% per month, charged after 7 days past the due date. We reserve the right to suspend work on any project with overdue invoices.

    All payments must be made via the payment method stated on the invoice.

    4. Revisions

    Projects include the number of revisions specified in the proposal, quote, or service package.

    Additional revisions, substantial changes to approved concepts, or requests outside the agreed scope may incur additional fees.

    5. Client Responsibilities

    Clients are responsible for providing accurate information, content, assets, feedback, and approvals required to complete the project.

    Any images, photographs, illustrations, logos, trademarks, or other materials supplied by the client must be owned by the client or used with the appropriate permission, licence, or copyright authorisation. Case Designs accepts no liability for copyright infringement arising from materials supplied by the client.

    Delays in providing requested materials, feedback, or approvals may result in project delays and adjusted delivery dates.

     

    6. Client Approval

    Clients are responsible for reviewing and approving all designs, content, and final artwork before production, publication, or implementation.

    Approval rounds delayed by the client may result in adjusted project timelines and revised delivery dates.

    Once final approval has been provided, Case Designs is not responsible for errors, omissions, spelling mistakes, factual inaccuracies, or other issues present in the approved version.

     

    7. Intellectual Property

    Ownership of final approved designs transfers to the client only upon full payment of all project fees.

    Until full payment is received, all concepts, drafts, and design work remain the property of Case Designs.

    Case Designs retains ownership of all preliminary concepts, unused designs, working files, templates, methodologies, and design processes unless otherwise agreed in writing.

    8. Portfolio Rights

    Unless otherwise agreed in writing, Case Designs reserves the right to display completed work within portfolios, social media, marketing materials, award submissions, case studies, and other promotional content.

    Confidential or unpublished work will not be shared without client consent.

    9. Artificial Intelligence (AI)

    Case Designs is committed to providing human-led design services.

    All final creative decisions, design development, and project deliverables are created, reviewed, refined, and approved by a human designer.

    From time to time, artificial intelligence tools may be used to improve efficiency, assist with research, generate placeholder content, or create mock-up scenes and visual presentations.

    Any AI-assisted content is reviewed and refined as part of the design process. Artificial intelligence is used as a supporting tool only and does not replace professional design expertise, creative judgment, or human involvement in the final outcome.

     

    10. Confidentiality

    Any confidential information shared during a project will be treated as confidential and will not be disclosed to third parties unless required by law or authorised by the client.

     

    11. Third-Party Assets

    Projects may incorporate third-party assets including fonts, stock photography, illustrations, software, plugins, or other licensed resources.

    Any third-party fees associated with these assets will be disclosed to and approved by the client prior to purchase.

    Clients are responsible for complying with any ongoing licensing requirements attached to approved assets.
